U.S. Federal Laws Prohibiting Employment Discrimination

CIVIL RIGHTS ACT OF  1964  - TITLE VII - Prohibits employment discrimination based on race, color, religion, sex, or national origin. Equal Employment Opportunity Commission (EEOC)

 

EQUAL PAY ACT OF 1963 (EPA) - Protects men and women who perform substantially equal work in the same establishment from sex-based wage discrimination. (EEOC)

 

AGE DISCRIMINATION IN EMPLOYMENT ACTOF 1967 (ADEA) - Protects individuals who are 40 years of age or older from discrimination. (EEOC)

 

PREGNANCY DISCRIMINATION ACT OF 1978 - Amended Title VII to prohibit discrimination based on pregnancy, childbirth and related conditions. (EEOC)

 

AMERICANS WITH DISABILITIES ACT OF 1990 (ADA) -TITLE I - Prohibits employment discrimination against qualified individuals with disabilities in the private sector, and in state and local governments. (EEOC)

 

REHABILITATION ACT OF 1973 (SECTION 503) - Prohibits discrimination against qualified individuals with disabilities who work in the federal government.(OFCCP)

 

CIVIL RIGHTS ACT OF 1991 - Provides additional protections, including right to jury trial and authorizes compensatory and punitive damages in cases of intentional employment discrimination. (EEOC)

 

EXECUTIVE ORDER 11246 OF 1965  - Requires affirmative action plans of government contractors or subcontractors (Office of Federal Contract Compliance (OFCCP)

 

IMMIGRATION REFORM AND CONTROL ACT OF 1986 - Prohibits citizenship status discrimination and requires employers to verify the identity and work eligibility of all employees. Immigration and Naturalization Service (INS).

 

FAMILY AND MEDICAL LEAVE ACT (FMLA) OF 1993 - Allows covered employees up to 12 weeks of unpaid leave for the birth or adoption of a child, the serious illness of a family member or personal illness. U.S. Department of Labor  (DOL)

UNIFORMED SERVICES EMPLOYMENT AND REEMPLOYMENT ACT OF 1994 (USERA) - Prohibits discrimination against persons because of their service in the Armed Forces Reserve, the National Guard, or other uniformed services, provides job protection and rights of reinstatement, and strengthens the Veterans’ Reemployment Rights Statute.  Veterans Employment and Training Services (VETS) (DOL).
